These Terms & Conditions should be read alongside the Becky D Photography Privacy Policy, Cookie Policy and any booking confirmation, quotation, invoice, photography consent form or other agreement provided to you.
Where a specific written agreement or booking confirmation contains terms that are specific to your booking, those terms will apply alongside these Terms & Conditions.

2. Booking and Contract Formation
A booking is considered confirmed once Becky D Photography has confirmed the booking and any required booking payment or deposit has been received.
The contract between Becky D Photography and the client begins when the booking is confirmed.
The client is responsible for providing accurate contact information, booking information and any other information reasonably required to provide the photography service.
For commercial or corporate bookings, the person making the booking confirms that they have authority to enter into the agreement on behalf of the organisation where applicable.
3. Pricing and Payment
Prices are confirmed at the time of booking and may vary depending on the photography service, duration, location, number of images, usage requirements, additional services and any other requirements agreed with the client.
Any additional services, products, travel charges, image licensing, extended usage or other costs will be agreed with the client before they are incurred wherever reasonably possible.
Payment must be made by the date stated on the relevant invoice or booking confirmation.
Where payment is not received by the required date, Becky D Photography may suspend or cancel the booking, subject to any applicable legal rights and obligations.
4. Cancellation by the Client
If a client needs to cancel a photography booking, cancellation should be provided in writing as soon as possible.
Cancellation charges are intended to reflect the time reserved for the booking, preparation undertaken, costs incurred and the reasonable loss that may result from the cancellation.
For standard photography sessions:
-
Where a booking is cancelled 14 days or more before the scheduled photography date, Becky D Photography will normally offer a refund of amounts paid, less any reasonable costs already incurred which cannot be recovered.
-
Where a booking is cancelled less than 14 days before the scheduled photography date, the booking payment may be retained as a cancellation charge to reflect the loss of the reserved session and other reasonable costs.
-
Where the photographer is able to rebook the cancelled session with another client, Becky D Photography may, at its discretion, reduce or waive some or all of the cancellation charge where this results in a meaningful reduction in loss.
-
Nothing in these Terms & Conditions removes or limits any cancellation or refund rights that cannot lawfully be excluded.
For Mini Shoots, because these sessions are limited-date or limited-availability sessions:
-
Cancellation 7 days or more before the scheduled Mini Shoot will normally qualify for a refund of amounts paid, less any reasonable unrecoverable costs.
-
Cancellation less than 7 days before the scheduled Mini Shoot may result in the booking payment being retained as a cancellation charge.
-
Where a Mini Shoot can be successfully rebooked, Becky D Photography may, at its discretion, reduce or waive the cancellation charge.
Where a client does not attend a scheduled photography session without providing notice, this may be treated as a cancellation on the day and the booking payment may be retained.
These cancellation provisions are subject to the client's statutory rights.
5. Rescheduling by the Client
Where possible, Becky D Photography may allow a client to move their booking to an alternative date.
Rescheduling is subject to availability and is not guaranteed.
A request to reschedule made close to the scheduled session may be treated as a cancellation where the original session cannot reasonably be rebooked.
For Mini Shoots and other sessions taking place on specific advertised dates, rescheduling may not always be possible. Where an alternative date is unavailable, the cancellation terms above will apply, subject to the client's statutory rights.
6. Late Arrival
Clients are asked to arrive at the agreed location and be ready for the photography session at the scheduled start time. If the Client arrives late, the session will generally still finish at the originally agreed end time, meaning that late arrival will reduce the amount of photography time available.
Where my schedule allows, I may be able to extend the session to make up some or all of the lost time; however, this cannot be guaranteed.
Becky D Photography cannot be held responsible for photographs or specific shots that are not captured as a result of time being lost due to late arrival.
7. Weather and Outdoor Photography
Outdoor photography is dependent on suitable weather and safe conditions.
If Becky D Photography considers the weather or conditions to be unsuitable or unsafe for the scheduled photography session, the session will be rescheduled to another appropriate date at no additional photography fee.
This may include circumstances such as:
-
Heavy or persistent rain
-
Strong winds
-
Storms
-
Lightning
-
Extreme temperatures
-
Flooding
-
Unsafe ground conditions
-
Other weather or environmental conditions that could reasonably affect the safety or quality of the session
The final decision regarding whether outdoor conditions are suitable will rest with Becky D Photography, taking into account the safety of the photographer, client and any other people attending the session, as well as the ability to provide an appropriate photography service.
Where weather conditions are changeable, Becky D Photography may make a decision as close to the session as reasonably possible.
8. Location and Travel Charges
Photography sessions taking place within Hampshire and West Sussex are included within the agreed photography fee unless otherwise stated in the booking confirmation.
Where the agreed photography location is outside the county boundaries of Hampshire or West Sussex, a travel mileage fee of 50p per mile will apply.
The mileage charge will be calculated based on the distance reasonably required to travel to and from the agreed photography location.
Any significant additional travel costs, such as parking, tolls, congestion charges, permits or other unavoidable location-related costs, may also be payable by the client where applicable and will be communicated in advance where reasonably possible.
9. Client Responsibilities
The client is responsible for providing accurate information about the photography session, including:
-
The number of people attending
-
The presence of children
-
Pets attending the session
-
Accessibility requirements
-
Relevant location information
-
Any known hazards
-
Any specific photography requirements
-
Any information that may reasonably affect the safety or delivery of the photography service
Clients are responsible for supervising children and pets throughout the session unless otherwise agreed.
Clients must follow reasonable safety instructions given by Becky D Photography during the session.
The client is responsible for ensuring Becky D Photography has reasonable access to the agreed photoshoot location at the scheduled time, including arranging any necessary permissions or access with the property owner or relevant authority.
This covers:
-
Access to a client's home, venue or other agreed location.
-
Obtaining permission from a landlord, venue or property owner where required.
-
Making sure you can enter and carry out the photoshoot at the agreed time.
10. Safety in Client Homes and Private Locations
Where photography takes place inside a client's home or another private property, the client is responsible for ensuring that the environment is reasonably safe for Becky D Photography to work in.
The client must inform Becky D Photography in advance of any known hazards, dangerous animals, aggressive pets, unsafe areas, building works, hazardous substances or other circumstances that could reasonably present a risk.
This includes, but is not limited to:
-
Dangerous or aggressive dogs or other animals
-
Unrestrained animals that present a safety risk
-
Unsafe stairs or flooring
-
Building or renovation work
-
Exposed electrical hazards
-
Hazardous substances
-
Unsafe furniture or equipment
-
Fire or smoke hazards
-
Other dangerous conditions
Becky D Photography reserves the right to refuse to enter or remain in a property, pause a session or terminate a session where there is a reasonable concern about personal safety.
Where a session is stopped or terminated because of an undisclosed or unreasonable safety risk created by the client or conditions at the location, any refund or rescheduling will be considered based on the circumstances and any reasonable loss incurred.
Nothing in these Terms & Conditions requires Becky D Photography to place herself in an unsafe situation.
11. Pets
Pets are welcome at photography sessions where agreed in advance.
The client remains responsible for the behaviour, supervision and control of their pets at all times.
Becky D Photography may request that a pet is restrained, moved to another area or removed from the photography environment if its behaviour presents a safety risk.
Becky D Photography will not be responsible for missed photographs resulting from a pet being unable to participate safely.
12. Photographer Safety and Right to Stop a Session
Becky D Photography is entitled to stop, pause, relocate or terminate a photography session where she reasonably believes that continuing would create an unacceptable risk to her personal safety or the safety of another person.
This includes situations involving threatening behaviour, dangerous animals, unsafe locations, unlawful activity, harassment, intimidation, aggressive behaviour or other circumstances that make it unreasonable to continue.
Where a session is terminated because of serious or unreasonable behaviour by the client or because the client has failed to disclose a known safety risk, Becky D Photography may retain payments to the extent reasonably required to cover losses incurred, subject to applicable consumer law.
13. Photography Requests and Shot Lists
Clients are encouraged to provide any specific photography requests, preferred images, poses, group combinations, styling requirements or other important instructions before the scheduled photography session.
Becky D Photography will make reasonable efforts to accommodate agreed requests.
However, requests cannot be guaranteed where they depend on circumstances outside the photographer's control, including available time, lighting, weather, location, cooperation of children or pets, positioning, safety or other practical limitations.
Becky D Photography cannot guarantee that every requested image, pose, composition or combination will be achieved during the allocated session.
Where a client provides a shot list, the photographer may prioritise requests according to the time available and the practical circumstances of the session.
14. Artistic Style and Creative Approach
The client acknowledges that photography is a creative service and that Becky D Photography has an established photographic and editing style.
The client is booking Becky D Photography based on her portfolio and existing style.
While reasonable preferences and requests will be considered, the client acknowledges that:
-
Individual images will vary according to the circumstances of the session.
-
Exact poses, compositions, lighting conditions and images cannot be guaranteed.
-
The photographer will make creative decisions regarding composition, lighting, posing, editing and image selection.
-
A client's personal preference may differ from the photographer's artistic judgement.
The photographer will make every reasonable effort to deliver photographs of a professional standard consistent with her portfolio and the agreed service.
15. Image Quality, Weather, Lighting and Circumstances Beyond Our Control
Becky D Photography will make every reasonable effort to produce and deliver outstanding photographs.
However, the photographer cannot guarantee specific photographic conditions or results where these depend on circumstances outside her reasonable control.
This may include:

-
Available natural or artificial light
-
Cloud cover
-
Colour or appearance of the sky
-
Sunsets
-
Sun flare
-

-
Environmental conditions
-
Interference from members of the public
-
Restrictions at the photography location

Children or pets not cooperating
-
Other circumstances outside the photographer's reasonable control
The photographer cannot guarantee specific images, poses, expressions, backgrounds, lighting conditions or photographic results.
16. Image Selection and Editing
Becky D Photography will select and edit the images that form part of the agreed photography package.
The photographer retains creative discretion over the final selection of images.
RAW files, unedited files, rejected images, test images, duplicate images and other images not included in the agreed package are not supplied unless specifically agreed in writing.
Requests for substantial additional editing or changes outside the agreed editing style may incur an additional fee.
17. Image Delivery
Final photographs will normally be delivered within 3–10 days following the photography session.
Every reasonable effort will be made to deliver images as soon as possible.
During particularly busy periods, delivery may take longer than 10 days. If a significant delay is anticipated, Becky D Photography will aim to communicate this to the client.
The photographer will not compromise the editing process or the quality of the final images in order to meet an arbitrary delivery deadline.
Images will normally be delivered through an online gallery or other digital delivery method selected by Becky D Photography.
18. Image Download and Gallery Availability
Clients are responsible for downloading and securely storing their final photographs once they have been delivered.
Becky D Photography recommends that clients download their photographs within 30 days of delivery and make their own backup copies.
While Becky D Photography will make reasonable efforts to maintain access to delivered photographs, the photographer does not guarantee that an online gallery or original files will remain available indefinitely.
After a reasonable period, which may be 30 days or longer depending on the circumstances, Becky D Photography may remove galleries or delete original/client files as part of normal business data management.
Clients should therefore not rely on Becky D Photography as their permanent storage or backup provider.
The photographer will not normally be responsible for replacing files that a client has failed to download within the available gallery period.
19. Copyright and Ownership of Photographs
All copyright in photographs created by Becky D Photography remains with Becky Dyer / Becky D Photography unless copyright is expressly assigned to the client under a separate written agreement.
Purchasing photography services does not automatically transfer copyright ownership.
The photographer retains the right to reproduce, display and use photographs for purposes permitted under the client's agreement, subject to any applicable photography consent or privacy arrangements.

21. Corporate, Commercial and Business Usage
For corporate, commercial, branding and business photography, the client will receive the usage rights specifically agreed as part of their booking.
Unless otherwise agreed in writing, corporate clients may use, publish, exhibit and display the delivered photographs for their own promotional and business purposes.
This may include use on:

Printed marketing materials
-
Brochures
-
Business literature
-
Advertising
-

-
Public relations materials

Internal business communications
The client may not represent themselves as the photographer or claim that they created the photographs.
Where commercially used, the client must provide a reasonable credit to Becky D Photography / beckydphotography.com where practical and appropriate.
Where the client requires unrestricted commercial use without credit, resale, sublicensing, transfer of copyright or other rights beyond the agreed usage, this must be agreed in writing and may require the purchase of full copyright or an extended licence.
Any additional usage outside the agreed licence must be agreed in writing before that usage takes place.
22. Full Copyright Purchase
Clients may request to purchase full copyright ownership of commissioned photographs where this is available.
Any transfer of copyright must be agreed in writing and will only take effect once the relevant copyright assignment and any associated payment have been completed.
Unless a separate written copyright assignment has been completed, copyright remains with Becky D Photography.
23. Photographer Portfolio and Promotional Use
Personal Photography Clients
Where a personal client has provided appropriate consent, Becky D Photography may use photographs and video for portfolio, website, social media, advertising, marketing, competitions, awards, exhibitions and other promotional purposes.
Corporate, Commercial, Branding and Business Photography Clients
Unless otherwise agreed in writing before the photoshoot, Becky D Photography reserves the right to use content created as part of corporate, commercial, branding and business photography sessions for portfolio, website, social media, advertising, marketing, competitions, awards, exhibitions and other promotional purposes.
Where content includes identifiable individuals, its use will be subject to the relevant photography consent arrangements and applicable privacy and data protection requirements.
Where a client has not provided the necessary consent, or has notified Becky D Photography in writing that promotional use is not permitted, Becky D Photography will respect that decision, subject to any rights or uses otherwise permitted by law.
24. Privacy and Personal Information
Personal information collected in connection with a photography booking will be processed in accordance with the Becky D Photography Privacy Policy.
The Privacy Policy explains how personal information is collected, used, stored, shared and retained.
Where photographs contain identifiable individuals, additional photography consent or model release arrangements may apply.
25. Public Liability Insurance
Becky D Photography maintains public liability insurance appropriate to the photography services provided.
Clients remain responsible for ensuring that their own homes, properties, businesses, animals, children, guests and possessions are appropriately protected and supervised.
Nothing in these Terms & Conditions removes or limits any liability that cannot lawfully be excluded or limited.
26. Damage, Loss or Theft of Photography Equipment
Becky D Photography uses professional photography equipment, including cameras, lenses, lighting equipment, accessories and other specialist equipment, to provide photography services.
Clients are expected to take reasonable care around the photographer and her equipment during a photography session.
Where photography equipment is damaged, lost or stolen as a direct result of the negligent, reckless or intentional actions of a client, their children, guests, pets or other individuals under their supervision or control, the client may be held responsible for the reasonable and evidenced costs of repair or replacement, to the extent permitted by law.
This may include reasonable costs associated with:
-
Repairing damaged equipment.
-
Replacing equipment that is damaged beyond economical repair, lost or stolen.
-
Replacing essential accessories that are damaged, lost or stolen.
-
Reasonable additional costs directly arising from the incident, where these can be evidenced and are legally recoverable.
Any amount claimed will take account of the nature and extent of the damage, the age and condition of the equipment, any applicable insurance recovery and the reasonable cost of repair or replacement. Becky D Photography will not seek to recover more than the actual loss suffered.
Clients will not automatically be held responsible for accidental damage, ordinary wear and tear, equipment failure or damage that was not caused by their actions or the actions of individuals under their supervision or control.
Where damage or loss occurs, Becky D Photography will notify the client of the circumstances and any proposed claim, providing reasonable supporting evidence of the damage and associated costs.
Nothing in this section excludes or limits any rights or liabilities that cannot lawfully be excluded or limited under applicable law.
27. Product Delivery & Return Costs
For product, commercial or branding photography, the Client is responsible for arranging and covering all costs associated with delivering products or other items to Becky D Photography for photography, including postage, courier fees, packaging and any applicable delivery charges. Where products are required to be returned to the Client or another address following the photoshoot, the Client is also responsible for all return postage, courier and associated costs. Becky D Photography is not responsible for delays, loss or damage caused by third-party postal or courier services.
28. Loss, Damage, Interference and Technical Problems
Becky D Photography will take reasonable care when processing, editing, storing and delivering photographs.
However, the photographer cannot be held responsible for loss, corruption, damage or delay caused by circumstances outside her reasonable control, including equipment failure, software failure, storage failure, internet or telecommunications failure, cyber incidents, third-party platform failure, physical damage, loss or other unforeseen technical problems.
Where a technical or equipment failure prevents the photographer from completing a session, Becky D Photography will make reasonable efforts to provide an appropriate alternative, such as rescheduling the session or, where appropriate, providing a refund of payments made for services that cannot be supplied.
29. Force Majeure and Circumstances Outside Our Control
Becky D Photography will not be responsible for failure or delay in performing the photography service where this is caused by circumstances reasonably outside her control.
This may include serious illness, accident, bereavement, severe weather, natural disaster, transport disruption, government restrictions, venue closure, equipment failure, loss of access to a location, or other circumstances that make performance impossible or unsafe.
Where reasonably possible, the photographer will offer an alternative date or appropriate solution.

Where Becky D Photography terminates a booking for reasons attributable to the client, any refund will be considered having regard to the circumstances, services already provided and reasonable losses incurred.
Where Becky D Photography terminates a booking for reasons that are not the client's fault and the photographer cannot provide the agreed service, the client will normally be offered an alternative date or an appropriate refund for services not provided.
Nothing in this section affects the client's statutory rights.
31. Complaints
If a client has a concern about the photography service, they should contact Becky D Photography as soon as reasonably possible so that the issue can be investigated and, where appropriate, resolved.
Complaints should be submitted in writing to:
Becky D Photography

The photographer will consider complaints fairly and will make reasonable efforts to resolve genuine concerns.
32. Limitation of Liability
Becky D Photography will provide services with reasonable care and skill.
Nothing in these Terms & Conditions excludes or limits any liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights that cannot lawfully be excluded.
Subject to the above, Becky D Photography's liability in connection with a photography booking will, where legally permitted, be limited to the amount paid by the client for the affected photography service.
Becky D Photography will not be responsible for indirect or consequential losses where such exclusion is permitted by law.
This section does not affect any rights or remedies available to consumers under applicable law.
33. Third-Party Products and Services
Becky D Photography may use third-party services to provide photography services, including online galleries, payment providers, website providers, cloud storage, booking systems and other technology providers.
The availability of these services may be outside the photographer's control.
Where third-party services are used, they may be subject to their own terms and privacy policies.
34. Social Media and Online Sharing
Clients may share photographs supplied to them for their permitted personal or commercial use, subject to the usage rights set out in these Terms & Conditions.
Clients must not materially edit, manipulate, filter or otherwise alter photographs in a way that misrepresents the photographer's work without written permission.
Where reasonably possible, clients sharing photographs publicly are encouraged to credit Becky D Photography.
35. Promotional Competitions, Free Sessions and Model Calls
Where photography is provided free of charge or at a discounted rate as part of a competition, promotion, model call, portfolio-building session or other promotional activity, additional terms may apply.
Those additional terms will be provided to the participant before the session where applicable.
Unless otherwise stated, these Terms & Conditions continue to apply.
36. Changes to These Terms & Conditions
Becky D Photography may update these Terms & Conditions from time to time to reflect changes in the business, services or applicable law.
The version applicable to a booking will normally be the version provided to or accepted by the client at the time of booking.
Changes made after a booking has been confirmed will not retrospectively alter the agreed terms of that booking unless required by law or agreed with the client.
37. Governing Law
These Terms & Conditions are governed by the law of England and Wales.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights that provide otherwise.
Nothing in these Terms & Conditions prevents a consumer from exercising any statutory rights or remedies available to them.
38. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be interpreted or amended to the minimum extent necessary to make it lawful and enforceable where possible.
The remaining provisions will continue to apply.
39. Entire Agreement
These Terms & Conditions, together with the applicable booking confirmation, quotation, invoice, consent forms and any other written agreement expressly incorporated into the booking, form the agreement between Becky D Photography and the client in relation to the photography service.
If there is a conflict between these Terms & Conditions and a specific written agreement made for the booking, the specific written agreement will take precedence to the extent of that conflict.
